Detaining Drivers Involved in Accidents Involving Serious Bodily Injury or Death if Driver Does Not Have Valid Driver License and Evidence of Financial Responsibility

              - Detaining Drivers Involved in Accidents Involving Serious Bodily Injury or Death if Driver Does Not Have Valid Driver License and Evidence of Financial Responsibility
 
        
        
        
        
          
            
 
 An officer shall detain a driver without a warrant, as provided in §40-7-103, and bring the driver before a committing magistrate if the driver: 
 -  Is involved in an accident resulting in: 
 -  Serious bodily injury, as defined in § 55-50-502; or 
  -  Death; and 
  
   -  Does not have a valid driver license; and 
  -  Does not have evidence of financial responsibility as required by § 55-12-139.
