  1. The commissioner shall promulgate regulations fixing the establishing for any food or class of food, under its common or usual name so far as practicable, a reasonable definition and standard of identity, or reasonable standard of quality or fill of container, whenever in the judgment of the commissioner the promulgation of regulations will promote honesty and fair dealing in the interest of consumers.
  2. In prescribing a definition and standard of identity for any food or class of food in which optional ingredients are permitted, the commissioner shall, for the purposes of promoting honesty and fair dealing in the interest of the consumer, designate the optional ingredients that shall be named on the label.
  3. The definitions and standards so promulgated shall conform to the definitions and standards promulgated under § 401 of the federal act.
