Exemption From Physical Quorum Requirement for Participation by Electronic or Other Means

The board of trustees of the University of Tennessee, the advisory boards for the University of Tennessee institutions, the board of regents of the state university and community college system, and the state university boards are not subject to the requirement of § 8-44-108(b)(1) that a physical quorum be present at the location specified in the notice of the meeting as the location of the meeting in order to allow participation by electronic or other means of communication for the benefit of the public and the governing body in connection with any meeting authorized by law. To qualify for the exemption from the requirements of § 8-44-108(b)(1), pursuant to this subsection (a), an advisory board for a University of Tennessee institution must have had a physical quorum present at the location of a meeting at least one (1) time in the previous twelve (12) months.
The board of trustees of the University of Tennessee, the advisory boards for the University of Tennessee institutions that qualify for the exemption from the requirement under § 8-44-108(b)(1), the board of regents of the state university and community college system, and the state university boards are not subject to the requirements of § 8-44-108(b)(2) or (b)(3).
