Policy for Parents to View Photographs or Video Footage From Cameras on School Buses

A local board of education shall adopt a policy that establishes a process to allow a parent of a student to view photographs or video footage collected from a camera or video camera installed inside a school bus if the local education agency (LEA) has one (1) or more school buses operating in the LEA with a camera or video camera installed inside a school bus that is used to transport students to and from school or school-sponsored activities.
The policy must require that photographs or video footage be viewed under the supervision of the director of schools or a school official designated by the director of schools. The policy must comply with § 10-7-504, the Family Educational Rights and Privacy Act (20 U.S.C. § 1232g), and other relevant state or federal privacy laws. The policy must establish the duration for which an LEA must maintain photographs or video footage collected from a camera or video camera installed inside a school bus.
Nothing in this section requires a local board of education to purchase camera or video recording equipment for school buses that operate within the LEA.
As used in this section, “parent” means the parent, guardian, person who has custody of the child, or individual who has caregiving authority under § 49-6-3001.
