- Excluded Offenders
An offender convicted of any of the following offenses is ineligible to participate in the special alternative incarceration program:
- Class A felony;
- Aggravated robbery;
- An offense involving sexual contact or sexual penetration, as defined in § 39-13-501;
- An offense involving child abuse, child sexual abuse, or sexual exploitation of a minor;
- An offense involving the illegal distribution or sale of a controlled substance or controlled substance analogue to a minor;
- An offense involving serious bodily injury, as defined in § 39-11-106; or
- An offense involving death to a victim or bystander.
