§ 3165. Transfer of appropriation. Transfer of appropriations heretofore made to the New York state office of science, technology and academic research. Upon the transfer pursuant to section thirty-one hundred fifty-six of this title of the functions and powers possessed by and all of the obligations and duties of the New York state office of science, technology and academic research as established pursuant to article ten-B of the executive law to the foundation as prescribed by section thirty-one hundred fifty-six of this title, all appropriations and reappropriations which shall have been made available as of the date of such transfer to the New York state office of science, technology and academic research or segregated pursuant to law, to the extent of remaining unexpended or unencumbered balances thereof, whether allocated or unallocated and whether obligated or unobligated, shall be transferred to and made available for use and expenditure by the foundation and when appropriate made available to the regional partnerships for the same purposes for which originally appropriated or reappropriated and shall be payable on vouchers certified or approved by the commissioner of taxation and finance, on audit and warrant of the comptroller. Payments of liabilities for expenses of personal service, maintenance and operation which shall have been incurred as of the date of such transfer by the New York state office of science, technology and academic research, and for liabilities incurred and to be incurred in completing its affairs shall also be made on vouchers certified or approved by the executive director of the foundation, on audit and warrant of the comptroller. All of the assets and liabilities of the small business technology investment fund transferred from the New York state science and technology foundation to the urban development corporation pursuant to subdivision two of section two hundred nine-f of the executive law shall be transferred to the New York state foundation for science, technology and innovation established pursuant to this title.
