ANNOTATIONS

Contingent repeals. — Laws 2020, ch. 9, § 60 repealed 8-7-2 NMSA 1978, effective January 1, 2023, contingent upon certification by the secretary of state that the constitution of New Mexico has been amended as proposed by a joint resolution of the first session of the fifty-fourth legislature (Laws 2019, SJC/SRC/SJR Nos. 1 and 4, CA #1) at the general election to be held on November 3, 2020.

Equal protection challenge. — In the absence of any evidence regarding the relative population density of each of the five PRC districts or the maximum deviation among the districts, the court would not review the merits of a claim that Sections 8-7-6 to 8-7-10 NMSA 1978 violate the one person, one vote principle of the equal protection clause, because the PRC districts are not equally apportioned on the basis of population.
