Record and transcript of judgment by confession; execution.

The clerk shall record the confession of judgment in his court record for such county and shall issue the transcript of judgment or execution as in other cases or as may be stipulated between the parties pursuant to Section 39-1-13 NMSA 1978.

ANNOTATIONS

Confession judgment held not to abrogate warrant of attorney. — This section does not cover the same field as that occupied by the common-law practice of taking judgments on warrant of attorney, and does not abrogate such practice. First Nat'l Bank v. Baker, 1919-NMSC-009, 25 N.M. 208, 180 P. 291.
