1. The Attorney General or any district attorney to whom the Commissioner or any of the Commissioner’s authorized agents shall report any violation of this chapter shall cause appropriate proceedings to be instituted in the proper court without delay and to be prosecuted in the manner required by law.

2. Before any violation of this chapter is reported to the Attorney General or a district attorney for the institution of a criminal proceeding, the person against whom such proceeding is contemplated shall be given appropriate notice and an opportunity to present his or her views before the Commissioner or the Commissioner’s designated agent, either orally or in writing, in person or by attorney, with regard to such contemplated proceeding.
