Officer refusing to obey writ, proceedings. — If the officer, or person upon whom the writ of habeas corpus shall be duly served, shall refuse or neglect to obey the same, by producing the party named in the writ, and making a full and explicit return to such court, within the time required by this chapter, and no sufficient excuse for such refusal or neglect be shown, the court or officer before whom such writ shall have been made returnable shall, upon due proof of service thereof, forthwith issue an attachment against the delinquent, directed to the sheriff of any county within this state, commanding him forthwith to apprehend such delinquent, and to bring him immediately before such court or officer.
