Sec. 34.

A person or officer who receives any of the books distributed by the secretary of state that this act requires the person to retain, and each city, village, township, and county officer, shall deliver to his or her successor in office all of those books. A person who does not do so is liable to his or her successor for the cost of replacing those books and costs of suit. An action shall, on request, be brought and prosecuted by the prosecuting attorney for the county. A person who knowingly and willfully retains those books or refuses to deliver them to the successor officer is guilty of a misdemeanor punishable by imprisonment for not more than 90 days or a fine of not more than $50.00, or both.
