- Issuance of Certificate of Incorporation
If the Secretary of State shall receive, with respect to the proposed bank or trust company:
- The written approval of the department with a copy of the articles of incorporation attached;
- An affidavit executed by the duly authorized agent or publisher of the newspaper in which publication of the articles or a summary statement relating thereto is required by Code Sections 7-1-7 and 7-1-392 stating that the articles or the summary statement have been published as required by those Code sections;
- All fees and charges required by law and if, in addition, the name of the proposed bank or trust company continues to be reserved or is available,
the Secretary of State shall immediately issue to the incorporators a certificate of incorporation. The Secretary of State shall retain on file in his office a copy of the certificate, the articles, the department's approval, and the publisher's certificate.
