Provision in Group Disability Income Policies for Offsetting of Increased Social Security Benefits

No group disability income policy which integrates benefits shall provide that the amount of any disability benefit actually being paid to the disabled person shall be reduced by changes in the level of social security benefits resulting either from changes in the federal Social Security Act or due to cost-of-living adjustments provided in the federal Social Security Act, which become effective after the first day for which disability benefits become payable.

The 2019 amendment, effective July 1, 2019, deleted the subsection (a) designation; and deleted former subsection (b), which read: "This Code section shall apply to all group disability income policies delivered or issued for delivery in this state on or after July 1, 1979."
