Financial Interest in Transportation Facilities or Sale of School Buses, School Bus Equipment, or School Bus Supplies of State and Local School Authorities Prohibited

No member of the Department of Education or county school superintendent or member of the county board of education shall be financially interested in procuring and operating means or facilities for school bus transportation or in selling school buses, school bus equipment, or school bus supplies to county boards of education.

OPINIONS OF THE ATTORNEY GENERAL

It is clear that this section applies to all county boards of education without any exception. 1950-51 Op. Att'y Gen. p. 45.

County board cannot do business with private enterprise owned by board member.

- It is illegal for a county board of education to do business with a private enterprise, corporation, or partnership either partly or wholly owned by a member of the county board of education. 1960-61 Op. Att'y Gen. p. 148.

County board member prohibited from operating school transportation means or facilities.

- Member of a county board of education would be prohibited from operating either the means or the facilities for school bus transportation for the county board. 1952-53 Op. Att'y Gen. p. 56.

County commissioner not prohibited from operating school bus.

- Since this section does not apply to a county commissioner of roads and revenues (now county commissioner), there is no law prohibiting such an office holder from operating a county school bus. 1954-56 Op. Att'y Gen. p. 233.
