All purchases or contracts for purchases shall be made subject to the condition that the price paid by the state shall not exceed the price which may be offered by the publisher to any other school or school authority for substantially the same instructional materials and content.

The 2015 amendment, effective July 1, 2015, substituted "instructional materials and content" for "book" at the end of this Code section.

OPINIONS OF THE ATTORNEY GENERAL

Following policies of the State Board of Education are in accordance with this section: (1) the bid period for the annual adoptions is from August 1 to September 15; (2) prices bid must be current wholesale prices for the bid period based on the publishers' prices for the production year; (3) the publisher is requested to offer an exchange price bid; (4) the bid price shall be the same from the time of the adoption by the State Board of Education for a five-year period; (5) a bid is considered responsive only if the bidder has complied with all of the provisions outlined in the invitation to bid; and (6) the department staff reviews the bid prices of books offered and recommends to the state textbook committee those books for which it considers the prices to be exorbitant and therefore nonresponsive bids. 1968 Op.
