- Distribution of Misbranded Fertilizer Prohibited; When Misbranded
No person shall distribute misbranded fertilizer. A fertilizer shall be deemed to be misbranded if:
- Its labeling is false or misleading in any particular;
- It is distributed under the name of another fertilizer product;
- It is not labeled as required in Code Section 2-12-6 and in accordance with regulations prescribed under this article; or
- It purports to be or is represented as a fertilizer or is represented as containing a plant nutrient or fertilizer, unless such plant nutrient or fertilizer conforms to the definition of identity, if any, prescribed by regulations of the Commissioner. In adopting such regulations the Commissioner shall give due regard to commonly accepted definitions and official fertilizer terms.
