An LEA shall maintain a student receiving home or hospital instruction on the regular attendance roll and count the student as medically excused, except when a student is not available for home or hospital instruction, in which event the student may be counted absent.

ApplicabilityApplicability of D.C. Law 23-204: § 12 of D.C. Law 23-204 provided that the creation of this section by § 8 of D.C. Law 23-204 is subject to the inclusion of the law’s fiscal effect in an approved budget and financial plan. Therefore that amendment has not been implemented.
