(1) Effective July 1, 1977, the minimum wage for minors may be fifteen percent below the minimum wage for other workers; except that the full minimum wage shall be paid to any emancipated minor. An emancipated minor shall mean any individual less than eighteen years of age who:
Has the sole or primary responsibility for his own support;
Is married and living away from parents or guardian;
Is able to show that his well-being is substantially dependent upon being gainfullyemployed.
An employer may pay a rate of fifteen percent lower than the minimum wage topersons certified by the director to be less efficient due to a physical disability.
The director may issue only such rules as are necessary to carry out the provisions ofthis article and as are consistent with the purposes and intent of section 8-6-101 and section 15 of article XVIII of the state constitution; except that, if a higher minimum wage rate is established by applicable federal law or rules, the director's rules shall be consistent with such federal law or rules.
