(1) The department shall administer and enforce the provisions of this part 4 and shall promulgate and enforce rules, regulations, and standards necessary to carry out the provisions of this part 4 including, but not limited to:

  1. Regulations necessary to qualify the state for payments made available by congressto those states that meet federal standards of roadside advertising control;

  2. Regulations relating to the maintenance of nonconforming advertising devices;

  3. Regulations to control the erection and maintenance on all state highways of officialadvertising devices, directional advertising devices, on-premise advertising devices, and advertising devices located in areas zoned for industrial or commercial uses;

  4. Regulations governing the removal and acquisition of nonconforming advertising devices;

  5. Regulations necessary to permit the exemption of tourist-related advertising devicesby the secretary of transportation under 23 U.S.C. sec. 131 (o);

  6. Regulations governing specific information signs under section 43-1-420.

  1. Nothing in this part 4 shall be construed to permit advertising devices to be erectedor maintained which would disqualify the state for payments made available to those states which meet federal standards of roadside advertising control.

  2. The department may enter into agreements with the secretary of transportation of theUnited States to carry out the national policy concerning outdoor advertising adjacent to the interstate system and federal-aid primary highways and to accept any allotment of funds by the United States, or any department or agency thereof, appropriated in furtherance of federal-aid highway legislation.

  3. The rules and regulations of the department shall not impose any additional requirements or more strict requirements than those imposed by this part 4.
