(1) Any person who violates a rule or regulation promulgated by the chief pursuant to section 42-20-104 commits a class 3 misdemeanor and shall be punished as provided in section 18-1.3-501, C.R.S.

  1. Any person who violates a rule promulgated by the chief pursuant to section 42-20108 commits a class 2 misdemeanor traffic offense and shall be punished as provided in section 42-4-1701.

  2. No conviction pursuant to this section shall bar enforcement by the public utilitiescommission of any provision of title 40, C.R.S., with respect to violations by persons subject to said title.
