(1) An individual who is temporarily present in the United States may apply for an identification document under this section. The department shall issue an identification document if:

(a) The individual:

  1. Qualifies for the document applied for except for qualifications that conflict with thissection; and

  2. Produces documents that satisfy the department that the individual is lawfully present in the United States; and

(b) The federal government confirms the individual's status, including electronically through the SAVE system.
