(1) The general assembly hereby finds that it is in the interest of the people of this state to promote the production of energy and the disposal of solid waste in a manner designed to protect the environment; therefore, the general assembly hereby declares that it is the policy of this state to promote the development of systems which generate energy through the burning of solid waste in a manner designed to insure the maintenance of clean air standards.

  1. Prior to the construction of a solid waste-to-energy incineration facility, any unit oflocal government contemplating construction of such a facility may, by written request, require the commission to calculate the avoided cost to a specified electric utility for the purchase of energy and capacity by said utility from said contemplated facility. Pursuant to such request the utility shall provide the commission with all data necessary to calculate said cost.

  2. As used in this section, "solid waste-to-energy incineration facility" means a facilitywhere flammable waste material is used as a primary fuel for the production of electrical power the total output of which exceeds one hundred kilowatts.
