(1) Any person who violates any provision of this article or any rule adopted pursuant to this article is subject to a civil penalty, as determined by the commissioner. The maximum penalty shall not exceed one thousand dollars per violation.

  1. No civil penalty may be imposed unless the person charged is given notice and opportunity for a hearing pursuant to article 4 of title 24, C.R.S.

  2. If the commissioner is unable to collect such civil penalty or if any person fails topay all or a set portion of the civil penalty as determined by the commissioner, the commissioner may:

  1. Bring suit to recover the amount of the civil penalty plus costs and attorney fees byaction in any court of competent jurisdiction; or

  2. Refuse to renew any license authorized under this article that was issued to a personwho has not paid the civil penalty pursuant to section 35-80-106 (4).

(4) Repealed.
