(1) It is unlawful for any person to enter any active or inactive mine unless accompanied by, or with prior written permission from, the operator of said mine.
Persons desiring entry into abandoned mines, where the operator cannot be found,shall first secure written authorization from the office of the commissioner or the office of active and inactive mines.
Any person violating any provision of this section is guilty of a misdemeanor and,upon conviction thereof, shall be punished by a fine of not less than fifty dollars nor more than five hundred dollars, or by imprisonment in the county jail for not more than ten days, or by both such fine and imprisonment.
Each violation of this section shall be a separate offense.
