(1) A waste tire generator shall, as specified by the commission by rule:

  1. Register with the department;

  2. Affix a decal required pursuant to section 30-20-1417 (1) to the required location;

  3. Maintain records, including the manifest required by section 30-20-1417 (2), relatingto such generation;

  4. Engage only a registered waste tire hauler to transport the waste tires the generatorgenerates;

  5. Develop and maintain written criteria for distinguishing waste tires from used tires,keep the criteria on site, and make the criteria available for inspection;

  6. Clearly identify waste tires and used tires according to the criteria developed pursuantto paragraph (e) of this subsection (1); and

  7. Organize used tires for sale in a manner that allows the inspection of each individualtire.

(2) A waste tire generator is subject to the following requirements:

  1. A generator that is not also registered as a waste tire collection facility, waste tireprocessor, or waste tire monofill shall not have on site more than one thousand five hundred waste tires at any one time;

  2. A generator that sells replacement tires in Colorado shall not refuse to accept from acustomer, at the point of transfer, waste tires of the same general type and in a quantity at least equal to the number of new tires purchased;

  3. A generator may accept waste tires; and

  4. A generator shall complete and submit to the department self-certification documentation as required by the department.

(3) The department may issue a waiver relating to any requirement of this section.
