(1) The board of county commissioners of any county in this state may by resolution create an authority pursuant to the provisions of this part 4, which authority shall be a political subdivision of this state.
No resolution creating an authority under this part 4 shall be adopted by a board ofcounty commissioners unless prior notice of such action, including the date, time, and place of meeting of said board, shall be made by publication, and an opportunity to be heard in person or by counsel shall be afforded to persons desiring to appear.
The resolution creating such an authority shall contain the following:
The name of the proposed district, which shall include the name of the county and thewords "law enforcement authority";
A general description of the territory included in the authority, with such certainty toenable a property owner to determine whether or not his property is within the authority; and
Where applicable, the specific powers and duties of the authority, as provided in thispart 4, but if the authority is authorized to exercise all such powers and duties under this part 4, only a general statement to this effect need be included.
The resolution creating any such authority shall not take effect until thirty days following the canvass of votes cast at the election conducted pursuant to section 30-11-405.
On the effective date of such resolution, the board of county commissioners shall, exofficio, constitute the governing board of the authority and shall exercise the powers and duties prescribed in this part 4 and in the resolution.
