(1) The division may, in the name of the people of the state of Colorado, through the attorney general of the state of Colorado, apply for an injunction in any court of competent jurisdiction:

  1. To enjoin any person from committing any act prohibited by the provisions of thispart 5;

  2. To enjoin a certified person from practicing the profession for which he is certifiedunder this part 5.

  1. If it is established that the defendant has been or is committing any act prohibited bythis part 5, the court shall enter a decree perpetually enjoining said defendant from further committing said act or from practicing asbestos abatement.

  2. Such injunctive proceedings shall be in addition to and not in lieu of all penalties andother remedies provided in this part 5.

  3. When seeking an injunction under this section, the division shall not be required toallege or prove either that an adequate remedy at law does not exist or that substantial or irreparable damage would result from a continued violation.
