(1) Except as provided in subsection (2) of this section, there is established in each county of the state a county department of human or social services that consists of a county board of human or social services, a county director of human or social services, and any additional employees as may be necessary for the efficient performance of public assistance, as defined in section 26-2-103 (7), and medical assistance.

  1. Single entry point agencies established pursuant to part 1 of article 6 of this title 25.5,other than county departments of human or social services acting as single entry point agencies, may act as state designated agencies and are authorized to carry out functions as specified in part 1 of article 6 of this title 25.5 that are otherwise performed by county departments of human or social services.

  2. With the approval of the state department of human services, two or more countiesmay jointly establish a district department of human or social services. All duties and responsibilities for county departments of human or social services set forth in this title 25.5 also apply to district departments of human or social services.
