(1) Product modules shall be labeled with either:

  1. The manufacturer's or processor's bulk food container labeling plainly in view; or

  2. A counter card, a counter sign, or any other appropriate device bearing prominentlyand conspicuously the common name of the product, a list of ingredients in their proper order of predominance, and a declaration of artificial color or flavor and chemical preservatives if contained in the product.

  1. Any unpackaged bulk food need not comply with the labeling requirements of thissection if the unpackaged bulk food is manufactured on the premises of a store or manufactured by the same store at a different location and if the manufactured bulk food is offered for retail sale on the store's premises and if there are no state requirements.

  2. Labels or marking pens shall be available to customers to identify their take-homecontainers with the common name of the product unless the product is readily identifiable on sight.
