(1) As used in this article, "electronic signature" means an electronic sound, symbol, or process attached to or logically associated with a record and executed or adopted by a person with the intent to sign the record.
In any written communication in which a signature is required or used, any party tothe communication may affix a signature by use of an electronic signature that complies with the requirements of article 71.3 of this title for electronic signatures.
The use or acceptance of an electronic signature shall be at the option of the parties.Nothing in this section shall require any person to use or permit the use of an electronic signature.
In the event of any conflict between article 71.3 of this title and this article, saidarticle 71.3 shall control, but only to the extent of such conflict.
