(1) Except as otherwise limited by this article, the authority, acting through the board, has the power to:

  1. Have and exercise all rights, duties, privileges, immunities, liabilities, and disabilitiesof a body corporate and a political subdivision of the state;

  2. Sue and be sued;

  3. Have an official seal and to alter the same at the board's pleasure;

  4. Make and alter bylaws for its organization and internal management and for the conduct of its affairs and business;

  5. Maintain an office at such place or places within the state as it may determine;

  6. Acquire, hold, use, and dispose of property, real and personal, and its income, revenues, funds, and moneys;

  7. Receive and expend gifts, grants, and donations;

  8. Make and enter into all contracts, leases, and agreements, including intergovernmental agreements, that are necessary or incidental to the performance of its duties and the exercise of its powers under this article;

  9. Deposit any moneys of the authority in any banking institution within or outside thestate;

  10. Fix the time and place or places at which its regular and special meetings are to beheld;

  11. Hire a chief executive officer of the authority and authorize the chief executive officer to hire such other staff as deemed necessary for the operation of the authority; and

  12. Do any and all things necessary or convenient to carry out its purposes and exercisethe powers given and granted in this article.

(1.5) Notwithstanding section 29-1-102 (9), C.R.S., for fiscal year 2010-11 and thereafter, the fiscal year of the authority shall be the period commencing July 1 and ending June 30.

  1. The authority shall televise the proceedings of the Colorado house of representativesand senate and such other programming of a state governmental nature as the board may approve, including making available audio recordings of proceedings of the general assembly.

  2. All electronically recorded proceedings of any public body of the state, as defined insection 24-6-402, and of all other types of meetings, sessions, conferences, or public events televised by the Colorado channel authority shall be the property of the state of Colorado and shall be public records under article 72 of this title. The Colorado channel authority and any other person or entity acting under contract with the authority shall be the official custodian under article 72 of this title of all such materials. Pursuant to section 24-72-205, the Colorado channel authority and, with the permission of the authority, any other person or entity acting under contract with the authority may charge reasonable fees for making materials subject to this subsection (3) available upon specific request. All electronically recorded proceedings of the judicial branch televised by the Colorado channel authority shall be subject to any rules promulgated by the supreme court or by the order of any court pursuant to section 24-72-204 (1)(c) or 24-72-305 (1)(b).
