(1) There is hereby created a fund in the state treasury to be known as the Colorado travel and tourism promotion fund, which shall be administered by the board and which shall consist of:

(a) All money transferred thereto in accordance with sections 38-13-801.5 (3) and 44-30-

701 (2); and

(b) Any moneys appropriated thereto by the general assembly.

  1. There is hereby created a fund in the state treasury to be known as the Coloradotravel and tourism additional source fund, which shall be administered by the board and which shall consist of:

  1. Any grants, donations, gifts, or other moneys provided to the state for the promotionof travel or tourism in the state; and

  2. All moneys that otherwise may be made available to the additional source fund or theoffice to be expended for the purposes set forth in this article.

  1. (a) The moneys in the fund shall be annually appropriated by the general assembly for the purposes of this article. All moneys not appropriated, including interest earned on the investment or deposit of moneys in the fund, shall remain in the fund and shall not revert to the general fund of the state at the end of any fiscal year. Any moneys not expended or encumbered from any appropriation at the end of any fiscal year shall remain available for expenditure in the next fiscal year without further appropriation.

(b) The moneys in the additional source fund shall be continuously appropriated for the purposes of this article. All moneys not expended, including interest earned on the investment or deposit of moneys in the fund, shall remain in the additional source fund and shall not revert to the general fund of the state at the end of any fiscal year.

  1. and (5) Repealed.

(6) Notwithstanding any provision of paragraph (a) of subsection (3) of this section to the contrary, on June 30, 2011, the state treasurer shall deduct two million five hundred thousand dollars from the Colorado travel and tourism promotion fund and transfer such sum to the general fund.
