(1) There is created in the department of public safety and within existing resources the Colorado cybersecurity council. The council operates as a steering group to develop cybersecurity policy guidance for the governor; develop comprehensive sets of prioritized goals, requirements, initiatives, and milestones; and coordinate with the general assembly and the judicial branch regarding cybersecurity as deemed necessary and appropriate by the council.

(2) The Colorado cybersecurity council is comprised of the following members:

  1. The governor, acting as the chairperson of the council, or the governor's designee;

  2. The chief information officer of the governor's office of information technology, orthe chief information officer's designee;

  3. The chief information security officer of the governor's office of information technology, or the chief information security officer's designee;

  4. The executive director of the department of public safety, or the executive director'sdesignee;

  5. A representative of the Colorado National Guard to be appointed by the adjutantgeneral of the department of military and veterans affairs;

  6. The adjutant general of the department of military and veterans affairs;

  7. The director of the Colorado office of economic development, or the director's designee;

  8. The aerospace and defense industry champion in the Colorado office of economicdevelopment;

  9. The director of the governor's office of state planning and budgeting, or the director'sdesignee;

  10. The executive director of the department of revenue, or the executive director's designee;

  11. The state controller;

  12. The state attorney general, or the attorney general's designee;

  13. The director of the public utilities commission or the director's designee;

  14. Representatives from institutions of higher education deemed necessary and appropriate by the governor;

  15. The state auditor, or the state auditor's designee; except that the state auditor or thestate auditor's designee shall be a nonvoting member of the council and shall act solely in an advisory capacity with respect to the council's activities;

  16. The chair of the cybersecurity subcommittee of the homeland security and allhazards senior advisory committee;

  17. The director of the division of homeland security and emergency management in thedepartment of public safety, or the director's designee; and

  18. Any other person deemed necessary and appropriate by the governor.

  1. The council does not have any direct authority over the university of Colorado atColorado Springs.

  2. Nothing in this section shall be construed to interfere with the duties of the chiefinformation security officer pursuant to part 4 of article 37.5 of this title.
