(1) There is hereby created in the state treasury the Colorado heritage communities fund, which fund shall be administered by the director and which shall consist of all moneys appropriated to said fund by the general assembly and all other moneys collected by the office for the fund from federal grants or other contributions, grants, gifts, bequests, or donations received from other agencies of state government, individuals, private organizations, or foundations. Such moneys shall be transmitted to the state treasurer to be credited to the fund.

  1. Not more than an amount equal to thirty percent of any moneys in the fund as of thebeginning of any given fiscal year shall be made available before the end of that same fiscal year to local governments in grant moneys for the development of master plans pursuant to section 24-32-3203 (3)(d).

  2. Any moneys in the fund not expended or encumbered from any appropriation at theend of any fiscal year shall remain available for expenditure in the next fiscal year without further appropriation.

  3. All moneys, including interest earned on the investment or deposit of moneys in thefund, shall remain in the fund and shall not revert to the general fund of the state at the end of any fiscal year.

  4. Repealed.
