(1) The department of personnel shall have the following powers and duties:

  1. To coordinate and administer a comprehensive risk management program that servesall state agencies;

  2. To administer, supervise, and manage the investigation and adjustment of claimsbrought against the state;

  3. To administer, supervise, and manage the legal defense of claims brought against thestate;

  4. To recommend to the executive director those persons or parties who may contractwith the state to provide claims investigation, claims adjustment, support services, or legal services;

  5. To assist and supervise any parties who have contracted with the state to provideclaims investigation, claims adjustment, support services, or legal services pursuant to this part 15;

  6. To develop and administer a system that identifies the property and liability losses,insurance costs, and administrative costs of risk management incurred by each state agency;

  7. To establish and administer a program to reduce property and liability losses incurredby each state agency;

  8. To establish and administer a program of inspection of state property;

  9. To investigate and to direct or deny payment for claims for loss or damage to stateproperty;

  10. To establish and administer a program for the payment or denial of liability claimsarising prior to September 15, 1985, for which no commercial liability insurance exists;

  11. To establish and administer a workers' compensation self-insurance program for stateemployees or to procure commercial workers' compensation insurance therefor;

  12. To establish and administer a pilot program beginning July 1, 1999, for the purposeof developing a statewide database and uniform reporting system to track employment claims brought against state agencies and the losses incurred as a result of such claims. The pilot program shall include:

(I) A minimum of three agencies selected by the department of personnel, including at least one institution of higher education and one department of the executive branch other than the department of higher education; and (II) Repealed.

(m) On and after July 1, 2001, to establish and administer a statewide database and uniform reporting system to track employment claims brought against state agencies and the losses incurred as a result of such claims, except as excluded pursuant to sections 24-30-1502 (5)(b) and 24-30-1517 (2).
