(1) There is hereby created a department of military and veterans affairs, the head of which shall be the adjutant general who shall be appointed by the governor pursuant to law.

  1. The office of the adjutant general, created by part 1 of article 3 of title 28, C.R.S.,and its powers, duties, and functions are transferred by a type 2 transfer to the department of military and veterans affairs.

  2. The department of military and veterans affairs shall consist of the following divisions:

  1. The Colorado National Guard, created by part 2 of article 3 of title 28, C.R.S. Itspowers, duties, and functions are transferred by a type 2 transfer to the department of military and veterans affairs as a division thereof.

  2. The Colorado department of civil air patrol, created by article 1 of title 28, C.R.S. Itspowers, duties, and functions are transferred by a type 1 transfer to the department of military and veterans affairs as the Colorado division of the civil air patrol.

  3. Repealed.

  4. The Colorado state defense force, when organized by the governor pursuant to article4 of title 28, C.R.S. If organized, its powers, duties, and functions are transferred by a type 2 transfer to the department of military and veterans affairs as a division thereof.

  5. Repealed.

  6. The division of veterans affairs, created by part 7 of article 5 of title 28, C.R.S. Itspowers, duties, and functions are transferred by a type 2 transfer to the department of military and veterans affairs as a division thereof.

  7. The Colorado board of veterans affairs, created by section 28-5-702, C.R.S. Its powers, duties, and functions are transferred by a type 2 transfer to the department of military and veterans affairs as a division thereof.
