(1) There is hereby created a department of law, the head of which shall be the attorney general.

  1. Except as otherwise provided in this article or by law, the powers, duties, and functions of the department of law, created by article 31 of this title, and all other powers, duties, and functions vested by law or the state constitution in the office of attorney general are transferred by a type 2 transfer to the department of law, subject to the state constitution.

  2. and (4) Repealed.
