(1) There is hereby created a department of state, the head of which shall be the secretary of state.

  1. The department of state and the office of secretary of state, created by article IV ofthe state constitution, and the powers, duties, and functions vested by law in said department and said office are transferred by a type 2 transfer to the department of state, subject to the state constitution.

  2. The department of state includes the electronic recording technology board established in section 24-21-402 (1), and its powers, duties, and functions, as if the board were transferred by a type 1 transfer, as such transfer is defined in section 24-1-105.
