(1) Effective June 30, 1998, the private occupational school policy advisory committee is abolished, and the terms of members of the advisory committee serving as such immediately prior to June 30, 1998, are terminated.

  1. Effective July 1, 1998, there is established, in the private occupational school division, the private occupational school board that shall advise the director on the administration of this article 64 and shall have the powers and duties specified in section 23-64108. The board shall exercise its powers and perform its duties and functions specified in this article 64 as if the same were transferred to the department of higher education by a type 1 transfer, as such transfer is defined in the "Administrative Organization Act of 1968", article 1 of title 24.

  2. The board shall consist of seven members appointed by the governor, with the consent of the senate, as follows:

  1. Three members shall be owners or operators of private occupational schools thatreceive Title IV funds;

  2. Four members shall be representatives of the general public, at least one of whom isemployed by a lending institution located in Colorado and is familiar with federal loans and funds authorized in Title IV of the federal "Higher Education Act of 1965", as amended, and at least two of whom are owners or operators of businesses within Colorado that employ students who are enrolled in schools that are subject to administration by the division.

  1. No appointed member shall be an employee of any local district college, communityor technical college, school district, or public agency that receives vocational funds allocated by any state agency.

  2. (a) The board members shall serve four-year terms; except that, of the members first appointed to the board, three members to be selected by the governor shall serve two-year terms. A member shall not serve more than two consecutive four-year terms.

  1. Notwithstanding the provisions of subsection (5)(a) of this section, of the three members appointed to replace persons whose terms expire on June 30, 2012, one member selected by the governor shall serve a two-year term, one member selected by the governor shall serve a three-year term, and one member selected by the governor shall serve a four-year term. Subsequent appointments to the positions identified in this subsection (5)(b) shall serve fouryear terms.

  2. Notwithstanding the provisions of subsection (5)(a) of this section, of the four members appointed to replace persons whose terms expire on June 30, 2014, one member selected by the governor shall serve a one-year term, one member selected by the governor shall serve a two-year term, one member selected by the governor shall serve a three-year term, and one member selected by the governor shall serve a four-year term. Subsequent appointments to the positions identified in this subsection (5)(c) shall serve four-year terms.

  1. The board shall hold regular meetings at such times as it may deem appropriate, butit shall not meet less than four times per year.

  2. Board members shall be paid a per diem of thirty-five dollars for each day on whichthe board meets and their actual and necessary expenses incurred in the conduct of official business.

  3. The division shall provide any necessary staff assistance for the board.
