(1) No person shall sell, rent, or otherwise furnish to a minor any video tape, video disc, film representation, or other form of motion picture if:
The average person, applying contemporary community standards, would find thatthe work, taken as a whole, predominantly appeals to the interest in violence; and
The work depicts or describes, in a patently offensive way, repeated acts of actual,not simulated, violence resulting in serious bodily injury or death; and
The work, taken as a whole, lacks serious literary, artistic, political, or scientificvalue.
For the purposes of this section, "minor" means any person under eighteen years ofage, and "serious bodily injury" shall be defined as provided in section 18-1-901 (3)(p).
Any person who violates subsection (1) of this section is guilty of a misdemeanorand, upon conviction thereof, shall be punished by a fine of one thousand dollars; except that, for a second or subsequent offense, the fine shall be five thousand dollars.
