(1) Prior to the initiation of an investigation or hearing, any licensee or temporary license holder may surrender his or her license to practice nursing.

  1. Following the initiation of an investigation or hearing and upon a finding that to doso would be in the public interest, the board may allow a licensee or temporary license holder to surrender his or her license to practice.

  2. The board shall not issue a license or temporary license or permit to a former licensee or temporary license or permit holder whose license has been surrendered unless the licensee meets all of the requirements of this part 1 for a new applicant, including the passing of an examination.

  3. The surrender of a license in accordance with this section removes all rights andprivileges to practice nursing, including renewal of a license.
