Section 45-11-172.08

THIS SECTION WAS ASSIGNED BY THE CODE COMMISSIONER IN THE 2019 REGULAR SESSION, EFFECTIVE MARCH 15, 2018. THIS IS NOT IN THE CURRENT CODE SUPPLEMENT.

A law enforcement officer may enforce this part by immediately removing a dog to an appropriate facility, without requirement for a warrant or pending due process, or both, if in responding to an incident covered by this part, he or she determines that the dog poses a threat to the public safety, regardless of the actions, omissions, or intent of the owner.
